These terms are a contract between you and Smartness Home, the French company that publishes Kalo.Quest (the "app"). By installing or using the app, you agree to them. If you do not agree, do not use the app.

Read this first. Kalo.Quest helps you estimate what you eat from a photo. It is a wellness and self-tracking tool, not medical advice, and its calorie and nutrition figures are AI estimates that can be wrong. Do not use it to make medical decisions. Talk to a qualified professional before changing your diet, especially if you are pregnant, have an eating disorder, diabetes, or any medical condition.

1. Who can use Kalo.Quest

You must be at least 16 years old to use the app. By using it, you confirm that you are, and that the information you enter about yourself is your own.

2. What the app does

You take a photo of a meal; the app sends it to an AI service that identifies the foods and estimates their weight, calories and macronutrients; you can adjust the result, and it is saved on your device. The app also lets you log weight, do no-equipment workouts to offset calories, earn trophies, and share branded cards of your progress. Everything is stored locally. There is no account and no cloud sync. Uninstalling the app deletes your data.

3. The estimates are approximate

Food recognition and portion weight are estimates produced by an AI model. They can misidentify a food, misjudge a portion, or be off by a wide margin. Use them as a guide, not as a measurement, and correct them when you know better. We do not guarantee the accuracy of any nutrition figure.

4. Not medical advice

Kalo.Quest is not a medical device and does not provide medical, nutritional or health advice. Nothing in the app is a substitute for the judgment of a physician, dietitian or other qualified professional. You use the app at your own risk and are responsible for your own health decisions.

5. Free and ad-supported

Kalo.Quest is free. There is no subscription, no in-app purchase, and no paywall. You get a set number of photo analyses per day, and an ad is shown after an analysis. That is what pays for the AI. Browsing what you've logged has no limit. If we ever introduce a paid option, these terms will be updated first.

6. Acceptable use

You agree not to:

use the app or our analysis service in a way that abuses, overloads or circumvents its limits, including automated or bulk requests;
copy, decompile, reverse-engineer or resell the app, except where the law expressly allows it;
use the app for anything unlawful.

7. Your content

The meal photos you analyze and the entries you log are yours. The photo is sent to our AI provider only to produce the analysis and is never stored (see the Privacy Policy). You are responsible for what you photograph and log.

8. Intellectual property

The app, the name Kalo.Quest, its design and its content are owned by Smartness Home and protected by law. We grant you a personal, non-exclusive, non-transferable license to use the app for your own, non-commercial use. All rights not granted are reserved.

9. "As is", no warranty

The app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and accuracy of results. We do not warrant that the app will be uninterrupted, error-free or available at all times.

10. Limitation of liability

To the fullest extent permitted by law, Smartness Home is not liable for any indirect, incidental or consequential damages arising from your use of the app, nor for any health outcome, decision or reliance based on its estimates. Nothing in these terms limits liability that cannot be limited by law, including your mandatory consumer-protection rights.

11. Changes and availability

We may update the app and these terms. Material changes are dated at the top of this page and, where they matter, signaled in the app. We may change, suspend or discontinue features. If you keep using the app after a change, you accept the updated terms.

12. Termination

You may stop using the app at any time by uninstalling it. We may suspend access if you breach these terms. Since your data is on your device, ending use is simply uninstalling. Nothing is held on our side.

13. Governing law

These terms are governed by French law, without prejudice to the mandatory consumer-protection rules of the country or U.S. state where you live, which continue to apply to you. If any provision is found unenforceable, the rest remains in effect.
